Overview
DRAFT DÚN LAOGHAIRE RATHDOWN COUNTY COUNCIL DEVELOPMENT CONTRIBUTION SCHEME 2023 – 2028
Under section 48 of the Planning and Development Act 2000, as amended, Planning Authorities may make a development contribution scheme in respect of certain public infrastructure and facilities provided by, or on behalf of, the local authority that generally benefit development within the administrative area of the Council.
Monies collected under Development Contribution scheme are allocated to the funding of public infrastructure and facilities described in section 48(17) of the Planning and Development Act 2000, as amended
Dún Laoghaire-Rathdown County Council has prepared a draft Development Contribution Scheme, "Draft Dún Laoghaire Rathdown County Council Development Contribution Scheme 2023 – 2028", this is in accordance with the provisions of the Planning and Development Act 2000 (as amended).
Contributions are propsoed to be collected the Draft Development Contribution scheme are allocated to three classes of public infrastructure,Community & Parks facilities & Recreational amenities, Transport Infrastructure and Surface Water Infrastructure
Details of the proposed contributions under the "Draft Dún Laoghaire Rathdown County Council Development Contribution Scheme 2023 – 2028" for the administrative area Dún Laoghaire Rathdown County Council are set out in table A & B below. For applicable development(s) within the administrative area of Dún Laoghaire Rathdown County Council the Countywide Table A applies and for development(s) in the Sandyford Urban Framework Plan Area, Table A & B applies

Submissions or observations with respect to the proposed Draft Dún Laoghaire Rathdown County Council Development Contribution Scheme 2023 – 2028 must be made not later than 5.00p.m. on Monday 14th August 2023 as follows:

In writing to the, Senior Executive Officer, Planning Department, Dún Laoghaire Rathdown County Council, County Hall, Marine Road, Dún Laoghaire and clearly marked “Draft Dún Laoghaire Rathdown County Council Development Contribution Scheme 2023 – 2028”

What happens next
Not later than 4 weeks after the expiration of the period for making submissions or observations, as per Section 48(4) Planning and Development Act 2000, as amended, a Chief Executives report shall be prepared on any submissions or observations received under that subsection, and submit the report to the members of the authority for their consideration. The report shall contain the following information, a list the persons or bodies who made submissions or observations under this Section 48(4) Planning and Development Act 2000, as amended, a summary of the issues raised by the persons or bodies in the submissions or observations, and give the response of the chief executive to the issues raised, taking account of the proper planning and sustainable development of the area.
The members of the planning authority shall consider the draft scheme and the report of the Chief Executive as per Section 48(6) Planning and Development Act 2000, as amended and shall have regard to any recommendations made by the Minister under Section 48(5) Planning and Development Act 2000, as amended.
Following the consideration of the Chief Executive’s report, and having had regard to any recommendations made by the Minister, the planning authority shall make the scheme, unless it decides, by resolution, to vary or modify the scheme, otherwise than as recommended in the Chief Executive’s report, or otherwise decides not to make the scheme
Where a planning authority makes a scheme in accordance with Section 48(8) Planning and Development Act 2000, as amended, the authority shall publish a notice of the making, or approving, of the scheme, as the case may be, in at least one newspaper circulating in its area. The notice shall included the following, the date of the decision of the planning authority in respect of the draft scheme, state the nature of the decision, and contain such other information as may be prescribed.
