Proposed Amendment 8 was lodged with An Bord Pleanála on 1 June 2021. It was considered at a Special Meeting of the County Council on 25th April 2023, at which it was agreed by resolution to make the proposed Amendment, as per  Section 169 (4)(b)(i) of the Planning & Development Act 2000 (as amended) subject to all (nine) of the variations or modifications, to the Cherrywood SDZ Planning Scheme 2014 (as amended). Any person or body who made submissions or observations in respect to the proposed Amendment No. 8, may for stated reasons, within four weeks of the date of the decision of Dun Laoghaire - Rathdown County Council (i.e., 4 weeks from the 25th April 2023 and not later than 23 May 2023), appeal the decision of the Planning Authority to An Bord Pleanála. Preamble:

Dún Laoghaire-Rathdown County Council as the Development Agency appointed by Government to promote the Cherrywood Strategic Development Zone (SDZ) Planning Scheme made an application to An Bord Pleanála to amend the approved Cherrywood Planning Scheme 2014 (as amended). An Bord Pleanála advised that in relation to the proposed building height and density review amendments to the Scheme, the Board deemed it to be a material change and in accordance with Section 169 of the Planning and Development Act, 2000, as amended, a public consultation was required.  

Proposed Amendment No. 8 (Building Heights and Density Review) of the adopted Cherrywood Strategic Development Zone (SDZ) Planning Scheme, 2014, as amended, was placed on public display for a period of 6 weeks from 26th of July to 7th of September 2022. At the end of the display period, a total of 32 submissions (plus two submissions from prescribed statutory bodies) were received in response to that consultation process.

This Proposed Amendment was considered at a Special Meeting of the County Council on 10th of November 2022. It was agreed by resolution to make the proposed Amendment, but subject to modifications as per Section 169 (4)(b) of the Planning & Development Act 2000 (as amended). The proposed modifications/material alterations are now the subject of this second public display.

Notice of the Display of Proposed Modifications/Material Alterations to the Proposed Amendment No. 8 to the Cherrywood Strategic Development Zone Planning Scheme in relation to Building Heights and Density Review and associated Strategic Environment Assessment and Appropriate Assessment Screening Reviews and associated Determinations.  

Notice is hereby given pursuant to Section 169 (4) of the Planning and Development Act, 2000 as amended, Article 179 of the Planning and Development (Strategic Environmental Assessment) Regulations, 2004, and Habitats Directive 92/43/EEC that a copy of the Proposed Modifications/Material Alterations to the Proposed Amendment No. 8 to the Cherrywood Strategic Development Zone Planning Scheme, 2014, as amended, in relation to Building Heights and Density Review, along with the reports to inform screening for Strategic Environmental Assessment (SEA) and Appropriate Assessment (AA) and associated Determinations on the proposed modifications/material alterations may be inspected at the following locations during normal opening hours, for a specified period of not less than 4-weeks from Thursday 5th of January 2023 to Tuesday 7th of February 2023 inclusive: 

  1. The Planning Department, County Hall, Marine Road, Dún Laoghaire, between 10.00am to 4.00pm Monday to Friday, excluding Bank Holidays, and 
  2. The Council Offices, Dundrum Office Park, Dundrum, between 9.30am to 12.30pm and 1.30pm to 4.30pm Monday to Friday, excluding Bank Holidays, and 
  3. Via the dlr consultations on the Council’s website homepage https://www.dlrcoco.ie and at https://dlrcoco.citizenspace.com 

A series of Public Information Sessions, to be attended by FPI Planning Officials are scheduled for the following dates and venues:  

Written submissions or observations with respect to the Proposed Modifications/Material Alterations and associated environmental Determinations are invited from members of the public and other interested parties including children, groups, or associations representing the interests of children and may be made in writing to the Planning Authority not later than 7th of February 2023 as follows:

Submissions and observations cannot be accepted in any other format or to any other online or postal address. 

Please Note

In accordance with Section 169 (4) of the Planning and Development Act, 2000 as amended, only submissions or observations in relation to the Proposed Modification/Material Alterations and/or SEA Screening and Determination and/or AA Screening and Determination of implementing the proposed modifications/material alterations to the proposed Amendment No. 8 will be taken into consideration.
